EXPLANATIONS ABOUT THE VAT SYSTEM
Mode of VAT-tax for the countries of the European Community
- When the vehicule is purchased by a private person:
- The VAT is due in the country of purchase of the vehicle (Belgium : 21% of VAT)
Example : a person from Spain wants to buy a car in Belgium wich includes a deductible VAT: the Spanish buyer needs to pay the 21% (Belgian VAT) when purchasing the vehicle.
- When the vehicle is purchased by a company:
- The company buys the vehicle without paying the Belgian VAT (so far as its in order with all the EU VAT regulations) and will have to pay the VAT in its country after having repatriated the vehicle. The applicable VAT rate will be the one of the country of importation (example : Spain : 16% VAT rate).
- In order to make a vehicle sale without VAT (netto sales price) to an EU company it's necessary:
* to carry out the payment by bank transfer.
* to present a proof of transport of the vehicle to its country of importation.
* to send by fax a purchase order.
Or: a guarantee can be deposited for the VAT until this evidence is established.
Mode of VAT-tax for the countries outside of the European Community
The purchaser, company or private individual from outside the EU, who buys a vehicle in Belgium will not pay the VAT. He will have however to officially deposit a guarantee equivalent to the amount of the VAT, which will be restored to him as soon as he presents the EX1 document of export carrying the seal of the customs of the last European country wich he will cross to return in its country.
Remark: Proof of transport for sales excluding taxes (VAT):
This can be provided by a harbour proof (when the vehicle goes by sea) and is called Bill of Lading, or a road proof (when the vehicle goes by road) then called C.M.R. You can find all the characteristics of the vehicle on the transport proof : mark, model, year, underframe number, colour and registration number.
